Insurance

Dynamic DMV Mobility LLC maintains fleet insurance coverage for the vehicle only when the gig application is turned off. The renter's personal automobile insurance policy shall be primary for all claims arising from the use of the vehicle.

If the renter does not maintain a valid personal insurance policy, the renter must purchase Daily Rental Protection ($10.00 per day) and provide a valid major credit card with an available credit limit equal to or greater than the vehicle's full market value.

Gig Platform Coverage

Insurance coverage varies depending on the vehicle's operating status:

  • Period 0 (Application Off): Fleet insurance coverage applies.
  • Period 1 (Application On, Waiting for Ride Requests): The renter is fully responsible for all damages, claims, losses, and liabilities.
  • Periods 2 and 3 (Active Ride or Delivery): Insurance coverage provided by the applicable gig platform applies.

If the gig platform denies coverage for any claim, the renter shall be solely and fully responsible for all resulting costs, damages, liabilities, and expenses.

GPS Tracking and Vehicle Monitoring

The vehicle is equipped with GPS tracking technology and remote ignition disable capabilities. These systems are proprietary, and their locations within the vehicle are not disclosed.

By renting the vehicle, the renter expressly consents to continuous monitoring of the vehicle. Any tampering with, disabling, or removal of these systems constitutes a material breach of this agreement and may result in criminal or civil liability.

Limitation of Owner Liability (Graves Amendment)

Pursuant to the Graves Amendment (49 U.S.C. § 30106), Dynamic DMV Mobility LLC shall not be liable for any injury, death, property damage, or other loss arising from the renter's operation, possession, or use of the vehicle.

The renter assumes full responsibility for all liabilities associated with the vehicle's use and agrees to defend, indemnify, and hold harmless Dynamic DMV Mobility LLC from any third-party claims, damages, judgments, or expenses.

Authorized Vehicle Use

The vehicle may not be sublet, re-rented, leased, or listed on any third-party vehicle-sharing platform, including but not limited to Turo, HyreCar, or Getaround.

The following activities are strictly prohibited:

  • Driving under the influence of alcohol or drugs.
  • Street racing or reckless driving.
  • Transporting illegal substances.
  • Any unlawful use of the vehicle.

Vehicle operation is restricted to Maryland, Virginia, and the District of Columbia. Any violation of these restrictions may result in immediate termination of the rental agreement, forfeiture of deposits, vehicle repossession, and full financial responsibility for all resulting damages and costs.

Vehicle Condition and Return Requirements

The vehicle will be delivered in clean condition with a full fuel tank and must be returned in the same condition.

The following charges may apply:

  • Minimum cleaning fee: $250.00
  • Fuel replacement cost plus a $25.00 service fee if the vehicle is returned with less than a full tank

The renter is responsible for all vehicle damage, theft, loss, towing charges, storage fees, and diminished value, regardless of fault.

Maintenance and Repairs

Routine maintenance is required every 30 to 45 days. All scheduled maintenance costs will be paid by Dynamic DMV Mobility LLC.

The renter must immediately report any warning lights, mechanical issues, or maintenance concerns. No repairs, modifications, or maintenance work may be performed without prior written authorization from Dynamic DMV Mobility LLC.

Accident Reporting Requirements

In the event of an accident, the renter must:

  1. Contact emergency services (911) immediately if necessary.
  2. Notify Dynamic DMV Mobility LLC within two (2) hours by calling (240) 574-9019.
  3. File a police report within twenty-four (24) hours when required by law.
  4. Photograph all vehicles, damages, road conditions, and relevant details.

Failure to comply with these reporting requirements constitutes a material breach of this agreement.

Background Screening

All renters are subject to a motor vehicle record (MVR) review and criminal background screening.

Social Security numbers and dates of birth are collected solely for screening and verification purposes. Such information is encrypted, securely stored, and will not be sold or shared except as required by law.

Governing Law and Dispute Resolution

This agreement shall be governed by and construed in accordance with the laws of the State of Maryland.

Any dispute arising out of or relating to this agreement shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules and procedures.
